The Responsibility to Protect and its Application in Myanmar

Abstract:

Bakalářská práce se věnuje přetrvávajícímu konfliktu v jedné z administrativních oblastí Myanmaru, tzv. Rakhinském státě. Zde dochází ke státem podporované diskriminaci Rohingů, která patří mezi menšinové etnické skupiny. Cílem práce je zjistit, zda v Myanmaru byly nebo stále jsou páchány mezinárodní zločiny na rohingské menšině a zda, popřípadě jakým způsobem, do konfliktu zasahují ostatní státy světa. Teoretické východisko představuje koncept Odpovědnost za ochranu (anglicky Responsibility to Protect, R2P), který byl vytvořen za účelem ochrany obyvatelstva před porušováním lidských práv. Umožňuje státům se za určitých podmínek vměšovat do vnitřních záležitostí jiného státu. Z výzkumu vyplývá, že jsou v Myanmaru páchány mezinárodní zločiny a stát selhává v ochraně vlastního obyvatelstva. Zároveň již v případě Myanmaru mezinárodní společenství aplikovalo postupy, které jsou v souladu se všemi třemi pilíři konceptu R2P.

Abstract:

The bachelor thesis devotes to the persisting conflict in one of the Myanmar's administrative areas, the so-called Rakhine State. There is a state-supported discrimination against Rohingya, who belong to the minority ethnic groups. The aim of the thesis is to determine whether international crimes against the Rohingya minority have been committed in Myanmar and whether, or in what way, other nations of the world are intervening in the conflict. The theoretical background gives the concept of Responsibility to Protect (R2P), which was established to protect the population from human rights violations. Thanks to the concept and under certain conditions, states are allowed to interfere in the internal affairs of another state. Research shows that international crimes are being committed in Myanmar and the state is failing to protect its own population. At the same time, in the case of Myanmar, the international community has already applied procedures that are consistent with all three pillars of the R2P concept.
