Abstract:
Práce je zaměřena na rozčlenění pravomocí mezi členské státy a ES/EU. Hodnotí současný stav rozdělení pravomocí mezi jednotlivé roviny, tj. národní a komunitární (evropskou). Práce vychází u primárního práva a jeho dotvoření judikaturou ESD. Současně práce představuje úpravu rozdělení pravomocí de lege ferenda, tj. podobu navrhovanou Smlouvou o Ústavě pro Evropu.
Abstract:
This master thesis is focused on the division of powers between the EC/EU and the member states. It examines the current legal regulation and the major decisions of the ECJ concerning the problem. Furthermore, the thesis offers a view of the legal regulation presented by the Treaty establishing the Constitution for Europe.
