Development of humanitarian interventions from the end of the Cold War until 2011

Abstract:

Diplomová práce je pojata jako případová studie humanitárních intervencí v návaznosti na doktrínu Responsibility to protect (RtoP), přičemž sleduje vývoj debat a přístupů k danému problému zejména od doby ukončení studené války do roku 2011, a to z hlediska vývoje názorů a postojů klíčových velmocí světa včetně Organizace spojených národů při řešení velkých humanitárních krizí. Práce bude realizována za pomoci kvalitativního výzkumu, prostřednictvím komparativní případové studie, kdy budou porovnávány, zohledňovány a posuzovány jednotlivé názory a přístupy k humanitárním intervencím v časovém úseku, mající zásadní vliv na danou problematiku. Časový úsek takového období tvoří konflikty ve Rwandě (1994), Kosovu (1999) a Libyi (2011). V rámci těchto konfliktů je znatelná změna přístupu, při kterém byla postupně suverenita státu a nedotknutelnost území podřazena zájmům na ochranu lidských práv. Nejprve v dané práci zazní teoretické úvahy, týkající se pojmu samotných intervencí. Částí práce bude věnována OSN, jako organizaci, mající zásadní autoritu při rozhodování o zásahu na území cizího státu, stanovení samotných podmínek. Analýze budou podrobeny vybrané kapitoly Charty OSN, mající zásadní vliv pro intervenci, v návaznosti vývoje konceptu odpovědnosti za ochranu. Těžištěm celé práce, jsou právě jednotlivé konflikty ve Rwandě, Kosovu a Libyi. U těchto konfliktů, v rámci kvalitativního výzkumu, za využití komparace, lze jednoznačně definovat vývoj postojů jak samotné OSN, tak klíčových velmocí, při řešení zmiňovaných konfliktů, s akcentem na postupné upřednostňování ochrany lidských práv nad suverenitou státu, s ohledem na schválené pilíře konceptu RtoP. Dané konflikty byly vybrány cíleně, z důvodu jasné proměny přístupu jednotlivých aktérů, kdy by měla být zodpovězena otázka, zda je zasahování do fungování a uspořádání svrchovaných států v rámci humanitárních intervencí ze strany cizích subjektů efektivní a v souladu s mezinárodním právem. Závěr práce je ze strany autora diplomové práce věnován především nutnosti existence plánu pomoci, reagujícího na vnitřní situaci konkrétního státu zasaženého intervencí. Absence může mít fatální následky pro budoucí vývoj společnosti a samotného uspořádání, po ukončení uplatňování koncepce RtoP.

Abstract:

Resumé The diploma thesis is conceived as a case study of humanitarian interventions in connection with the doctrine of Responsibility to protect (RtoP), while monitoring the development of debates and approaches to the problem, especially since the end of the Cold War until 2011, in terms of evolving views and attitudes of world powers including the United Nations in dealing with major humanitarian crises. The work will be carried out with the help of qualitative research, through a comparative case study, which will compare, take into account, and assess individual views and approaches to humanitarian interventions in a time period, having a major impact on the issue. The period is formed by the conflicts in Rwanda (1994), Kosovo (1999) and Libya (2011). Within these conflicts, there is a noticeable change in approach, in which the sovereignty of the state and the inviolability of the territory have gradually been subordinated to the interests of the protection of human rights. First, the thesis will include theoretical considerations regarding the concept of interventions themselves. Part of the work will be devoted to the UN, as an organization with fundamental authority in deciding on intervention in the territory of a foreign state and the determination of the conditions themselves. Selected chapters of the UN Charter, having a major impact on intervention, will be analysed in connection with the development of the concept of responsibility to protect. The focus of the whole work is the individual conflicts in Rwanda, Kosovo and Libya. In these conflicts, within the framework of qualitative research, using comparison, it is possible to clearly define the development of attitudes of both the UN itself and key powers in resolving these conflicts, with an emphasis on gradually prioritizing the protection of human rights over state sovereignty, with regard to approved pillars “RtoP”. The conflicts were selected in a targeted manner, due to a clear change in the approaches of the various actors. The question should be answered whether interference to the functioning and organization of sovereign states in humanitarian interventions by foreign actors is effective and in line with international law. The conclusion of the thesis is mainly devoted to the need for the existence of a plan of assistance, responding to the internal situation of a particular state affected by the intervention. Absence can have fatal consequences for the future development of society and the organization itself, after the end of the application of the RtoP concept.
