Adapting the Owners Association Statutes to the Current Legislation

Abstract:

Práce podává ucelený pohled na problematiku přizpůsobení stanov společenství vlastníků vzniklých do 31. 12. 2013, která mají povinnost uvést v soulad svoje statusy s ustanoveními zákona č. 89/2012 Sb. Za tímto účelem provádí srovnání původní právní úpravy regulující společenství vlastníků se současnou právní úpravou, vyhodnocuje klíčová ustanovení a navrhuje optimální změny vycházející ze zažité praxe. Součástí práce je také návrh stanov, které odpovídají požadavkům zákona a které lze v praxi využít. V závěru hodnotí obdobný proces, který nastal na Slovensku a konfrontuje jej především s aktuálním problémem v podobě procesu přizpůsobení stanov akcentovaný otázkou potřeby vyhotovení notářského zápisu svědčící o této skutečnosti.

Abstract:

This thesis gives a comprehensive view on the issue of adapting the Statutes of fellowship of owners established by 31 December 2013 which have a duty to reconcile their status with the provisions of Act no. 89/2012 Coll. To this end, it implements a comparison of the original law regulation of the fellowship of owners with the current legislation, evaluates the key provisions and proposes optimal changes resulting from conventional practice. The thesis also includes a draft of Statutes that meet the requirements of the Act and which can be used in practice. In conclusion, it evaluates a similar process that occurred in Slovakia and confronts it with the current problem, mainly regarding the adaptation process of the Statutes accented by the need of notarial deed of this fact.
