Re-codification of the Czech Accounting Law

Abstract:

Diplomová práce se zabývá rekodifikací českého účetního práva. Cílem diplomové práce je shrnout současný stav právní úpravy českého účetnictví, popsat způsob regulace účetnictví, koncepční rámce účetního výkaznictví a postup legislativních prací, který směřuje k vydání nové účetní legislativy. Zároveň jsou vyhodnoceny některé očekávané změny účetní legislativy, účetních postupů, způsobů vykazování, rozsahu vedení účetnictví, zavedení funkční měny, změny limitů pro povinný audit, úpravy sankcí za účetní přestupky a úroveň digitalizace v účetních jednotkách. Na základě zjištění z vnějšího připomínkového řízení k návrhu nového zákona o účetnictví je proveden rozbor připomínek a jejich statistické vyhodnocení. Pro tyto účely jsou zmapovány nejzásadnější připomínky a zformulována k nim stanoviska. V závěru práce jsou popsána potenciální rizika spojená s rekodifikací českého účetního práva a je zhodnoceno, zda s ohledem na pozitivní i negativní dopady rozsáhlých změn na účetní jednotky může být rekodifikace krokem správným směrem.

Abstract:

The thesis deals with the recodification of Czech accounting law. The aim of the thesis is to summarize the current state of the legal regulation of Czech accounting, to describe the method of regulation of accounting, conceptual frameworks of financial reporting and the process of legislative work aimed at issuing new accounting legislation. At the same time, some expected changes in accounting legislation, accounting procedures, reporting methods, scope of accounting, introduction of functional currency, changes in limits for statutory audit, adjustments in penalties for accounting offences and the level of digitalization in accounting units are evaluated. On the basis of the findings of the external comment procedure on the draft new Accounting Act, an analysis of the comments and a statistical evaluation of them is carried out. For this purpose, the most important comments are mapped and opinions on them are formulated. The paper concludes with a description of the potential risks associated with the recodification of Czech accounting law and an assessment of whether the recodification may be a step in the right direction with regard to the positive and negative impacts of extensive changes on accounting entities.
