Using the weapon as the ultima ratio of the intercepting policeman

Abstract:

Bakalářská práce se zabývá zákonnými podmínkami, za kterých je příslušník Policie České republiky oprávněn použít zbraň. Řeší povinnosti policisty po použití zbraně a zvláštní omezení. Obsahem práce je komparace podmínek, za kterých je policista oprávněn použít zbraň s podmínkami stanovenými zákonem pro příslušníka Vězeňské služby České republiky. Zároveň je zde uveden rozbor statistik použití zbraně policistou a vězeňskou službou za shodné časové období. Výsledkem práce je zjištění, že zákonné oprávnění použití zbraně policistou je ve srovnání s použitím zbraně vězeňskou službou zrcadlově velmi podobné, každopádně policista má tyto pravomoci mnohdy rozsáhlejší.

Abstract:

This bachelor thesis deals with legal conditions for police officers in the Czech Republic when they are authorized to use a weapon. It focuses on obligations of police officers after using it and on special restrictions. The content of this work is comparison of conditions, under which is a policeman entitled to use a weapon, with conditions set by the law for a prison service of the Czech Republic. The work also contains analysis of statistics for using guns by policemen and members of a prison service for the same time period. The result of this thesis is that statutory authorization for using weapons for police officers is very simile to the one of the prison service. However, the powers of police officers are more extensive.
