Financial relations and the insolvency

Abstract:

Tato práce se zabývá problematikou finančních vztahů a stavu úpadku včetně jeho řešení. Práce zároveň upozorňuje na dichotomické řešení úpadku finančních institucí a ostatních subjektů finančního systému v souvislosti s novou právní úpravou řešící selhání finančních institucí. Práce se zabývá klíčovými aspekty insolvenčního řízení jako obecnou právní úpravou řešení úpadku a ozdravnými postupy jako specifickou formou sanace úpadku finančních institucí. V souvislosti se zkoumáním těchto postupů tak byla nezbytně řešena otázka míry přímých a nepřímých zásahů státu do řešení úpadku, a to zejména právě v souvislosti s úpadkem finančních institucí. Závěry této práce přispívají ke zjištění, zda veřejná moc a jí užívané nástroje při řešení selhání jsou legitimní a zároveň konformní s efektivním fungováním finančního systému.

Abstract:

This work deals with the issue of financial relations and the state of insolvency with its legal resolution. The thesis also highlights the dichotomous insolvency resolutions for financial institutions and other entities of the financial system in the context of new legislation regulating the failure of financial institutions. The work deals with key aspects of insolvency proceedings as a general legislation dealing with insolvency and recovery procedures as a specific form of rehabilitation of insolvent financial institutions. In connection with the examination of these procedures the question of the level of direct and indirect state intervention in resolving insolvency has to be essentially solved, especially in connection with the insolvency of financial institutions. The conclusions of this study help to determine whether a public authority, its tools in process of failure resolution are legitimate and compatible to the effective functioning of the financial system.
