Abstract:

Diplomová práci se zabývá platnou právní úpravou odposlechu a zá-znamu telekomunikačního provozu podle § 88 tr. řádu a řadou proble-matických aspektů, které jsou s ní a obecně se získávání obsahu sou-kromé komunikace pro účely trestního stíhaní, spojeny. Práci lze rozdě-lit do dvou částí. První část se zabývá konkrétními nedostatky platné právní úpravy odposlechu a záznamu telekomunikačního provozu, zejména tedy způsobem povolování a následnou kontrolou zákonností užití tohoto institutu. K těmto nedostatkům následně v práci navrhuji konkrétní řešení. Druhá část práce jde nad rámec platné právní úpravy odposlechu a zabývá se otázkou, do jaké míry lze jednotlivými instituty trestního práva procesního nahradit (obejít) právní úpravu odposlechu a zjistit obdobný obsah soukromé komunikace, bez zachování stejného standardu ochrany soukromí. Za účelem zodpovězení této otázky v práci provádím srovnání právní úpravy odposlechu s instituty zjištění údajů o telekomunikačním provozu podle § 88a tr. řádu, sledování osob a věcí podle § 158d tr. řádu, odnětí věci podle § 79 tr. řádu a domovní prohlídky podle § 82 tr. řádu. Na základě zjištění z předchozích dvou částí na závěr navrhuji de lege ferenda sjednocení právní úpravy odpo-slechu a dalších prostředků zjišťování obsahu komunikace tak, aby me-zi nimi byl zachován stejný standard ochrany soukromí bez ohledu na procesní postup, který k zjištění obsahu komunikace vede.

Abstract:

The diploma thesis deals with the valid legal framework of monitoring and interception of communication under § 88 of the Criminal proce-dure act as well as number of problematic aspects associated with it and, in general, with the acquisition content of private communication for purposes of criminal prosecution. The thesis can be divided into two parts. The first part of the thesis deals with specific shortcomings of the valid legal framework of monitoring and interception of commu-nication, especially the method of permitting and subsequent control of the legality of the use of this institute of criminal law. I subsequently propose a specific solution to these shortcomings. Second part of the thesis goes beyond the legal framework of monitor-ing and interception of communication and deals with the question of to what extent can law enforcement authorities replace (bypass) legal framework of monitoring and interception of communication under § 88 through the use of other institutes of criminal procedural law, in or-der to secure similar content of private communication, without main-taining the same standard of control of privacy. In order to answer this question, I compare the legal framework of monitoring and interception of communication under section 88 with other institutes of criminal procedural law of finding out data on tele-communications traffic pursuant to Section 88a of the Penal Code, mon-itoring of persons and things according to section 158d of the Penal Code, confiscation of property according to section 79 of the Penal Code and conducting house search according to section 82 of the Penal Code. Based on the findings from the previous two parts, I propose de lege ferenda the unification of the legislation on acquisition content of pri-vate communication and other means of determining the content of communication so that the same standard of privacy is maintained be-tween them regardless of the procedural procedure leading to finding out the content of communication.
