Lawful Expropriation in International Law

Abstract:

The present paper explores the basic theoretical and judicial dimensions of the expropriation of alien property with particular focus on the regulatory taking doctrine. The main issue is to determine the criteria how to distinguish between the regulatory effect of the state measure and the expropriatory effect of such measure. First section of the survey is focused on the historical background of the law of expropriation of foreign property and shows that three conditions are essentially needed to fulfill the standard of international law. The other part of the first section contains an explanation of terminology together with a presentation of the theoretical concepts of the expropriatory measures. Second section presents the decisions of international tribunals with focus on the question what constitutes the taking with special attention to the regulation and deprivation relationship. The third section describes the attitude of the European Court of Human Rights in interpreting the peaceful enjoyment of property clause Article 1 of the Protocol No.1 of the European Convention on Human Rights, and particularly on the proportionality test that is applied by this Court. In the fourth section author concludes his work by showing the basic rules which are relevant to the present international law on expropriation in the first part of the section. In the second part of the conclusion the author presents his opinion about the relevant tests and how to distinguish between regulation and expropriation with the help of proportionality test.
