Abstract:

Hlavním cílem práce je podrobit analýze hodnocení účelnosti postupů insolvenčního řízení na příkladě vybraných firem. První část je věnována teoretickému přístupu k problematice. Zde je vysvětleno insolvenční řízení a pojmy, které jsou s ním spojeny. Dále je pozornost věnována subjektům insolvenčního řízení: soudu, věřitelským orgánům, insolvenčnímu správci a mnoha dalším. Poté je v teorii uveden popis úpadku a způsoby jeho řešení. Aplikační část již bude zaměřena na konkrétní případ řešení insolvence v podniku. Pro větší přidanou hodnotu je proces insolvence ukázán na dvou podnicích: na jednom, ve kterém insolvence proběhla zcela v pořádku, a na druhém, kde insolvenční proces nebyl tak úspěšný. Na konci práce se autor zamyslí nad celkovým zhodnocením případu – co proběhlo v pořádku, co nikoliv a v čem by se dal zlepšit proces insolvence. Práce je postavena na mnoha vědeckých metodách, mezi nejdůležitější patří analýza a syntéza. V praktické části se bude vyskytovat metoda komparace. Kromě toho je práce doplněna o matematicko-statistické indexy, v nichž poukážu na vývoj počtu insolvencí v ČR.

Abstract:

The main objective of this work is to explain the most important concepts and practice of insolvency procedures. The first part is dedicated to a theoretical approach to the issue. Here the author is explaining insolvency proceedings and the terms that are associated with it. Attention is also paid to entities insolvency proceedings: court creditor institutions, insolvency administrators, and many others. Theory ends with description of bankruptcy and ways of its solution. Application part is focused on the specific case of insolvency resolution in the company. For more added value the insolvency process is shown in two companies: one in which insolvency was perfectly fine, and in the second, where the insolvency process has not been so successful. At the end of the work, the author creating the overall evaluation of the case: what was done well, what did not and what could be improved in the insolvency process. The work is based on many scientific methods, the most important are analysis and synthesis. In the practical part also occurs comparative method. In addition, the paper includes the mathematical and statistical indices, while pointing out the evolution of the number of insolvencies in the Czech Republic.
