Reenactment of private law as a manifestation of discontinuance of legal order
Abstract:
Rekodifikace soukromého práva jako výraz diskontinuity právního řádu. Práce analyzuje polistopadové rekodifikační práce na soukromoprávním kodexu. Skrze nastínění obecných pojmů a přehled geneze soukromého práva na českém území, s důrazem na právo socialistické, rozebírá obecnou koncepci aktuálního rekodifikačního projektu. Následně vyvozuje závěry ohledně povahy a míry právní diskontinuity.

Recodification of private law as a manifestation of discontinuance of legal order. Paper analyses recodification works on civil code after November 1989. Sketching out some general concepts and reviewing history of Czech private law, particularly during socialistic era, it analyzes philosophy of contemporary private law recodification project.
