Ex lege and office administrator taxation in tax acting

Abstract:

Master thesis has an analytical-application character. It is aimed on examining the rights and obligations of the tax administrator in the tax proceedings. The starting point for our work are theoretical knowledges on the issue, namely the tax proceedings, tax control and the rights and obligations of the worker of the tax administrator. The theoretical part is included in the four subchapters. Current state of the solving issue is analyzed in the second part of the thesis. This part is included in the four subchapters where we address the influence of the changeover Euro to the tax administrator, payments of advances after chargeover for the euro, procedure of tax administrator and the local analysis of long-term trends in tax control. The third chapter focuses on the design of appropriate measures for the future of the tax administrator. It is contained in two chapters. These chapters show two model situations in the tax proceedings , namely tax control without announcement and invansion of goods. They are focused on the determination of rights and obligations of the tax administrator in a particular tax proceedings.

Abstract:

Diplomová práca má analyticko–aplikačný charakter. Je zameraná na skúmanie práv a povinností správcu dane v daňovom konaní. Východiskom pre našu prácu sú teoretické poznatky, týkajúce sa danej problematiky, konkrétne daňového konania, daňovej kontroly a samotných práv a povinností pracovníka správcu dane. Teoretická časť je obsiahnutá v štyroch podkapitolách. V druhej časti práce je analyzovaný súčasný stav riešenej problematiky. Táto časť je obsiahnutá v štyroch podkapitolách, kde sa venujeme vplyvu zavedenia Eura na správcu dane, platbe preddavkov po zavedení eura, postupu správcu dane pri zmene miestnej príslušnosti a analýze dlhodobých trendov v daňovej kontrole. Tretia kapitola je zameraná na návrh vhodných opatrení do budúcnosti pre správcu dane. Obsiahnutá je v dvoch kapitolách. Tieto zobrazujú dve modelové situácie v daňovom konaní a to daňovú kontrolu bez oznámenia a prepadnutie tovaru. Sú zamerané na stanovenie práv a povinností správcu dane v konkrétnom daňovom konaní.
