Circumvention of the working times statutory regulation in the CR with emphasis on the flexible forms of working and their legal regulation

Abstract:

Tato práce se zabývá úpravou pracovní doby a doby odpočinku a dále instituty s tímto tématem souvisejícími, tj. prací přesčas, pracovní pohotovostí a další dohodnutou prací přesčas ve zdravotnictví. V této souvislosti se zabývá primárně jejich teoretickým uchopením, se zohledněním příslušné judikatury a analyzuje způsoby, jakými smluvní strany pracovněprávních vztahů těchto institutů v praxi zneužívají, čímž taktéž obchází zákon, jeho cíl a účel. Dále pojednává o služebních telefonech a právní povaze jejich užívání při výkonu závislé práce. V neposlední řadě též zpracovává institut fixní mzdy a dohod o pracích konaných mimo pracovní poměr, které jsou rovněž využívány ze strany zaměstnavatelů k obcházení zákona. Pomyslná druhá část práce je pak věnována flexibilním formám zaměstnávání, kdy je nejprve pojednáno o účinné právní úpravě těchto institutů, následně je rozebírána navrhovaná novela zákoníku práce a v závěru je též obsažena kapitola o úpravě těchto institutů v EU a vybraných členských státech.

Abstract:

This dissertation deals with the regulation of working time and rest periods and the related institutes, specifically the overtime work, state of alert for work and the additional agreed amount of overtime work in health service. In this relation, it firstly describes the theoretical approach, with regard to the relevant judgments, and analyses the ways that are used by the contractual parties to abuse the goals and purposes and to avoid the law. Secondly it deals with the company mobile phones and the legal understanding of their usage to perform work. The following topic is the fixed wage and the agreements on work performed outside the employment relationship, which are also used by employers to bypass the legal provisions. The notional second part of the dissertation then concentrates on the flexible forms of work. Initially the effective legal regulation is mentioned and it is followed by the analysis of the suggested bill amending the actual Labour Code. The final chapter describes the regulation of flexible working in the EU and selected member states.
