Forensic Accounting and Economic Criminality in the Czech Republic

Abstract:

Předložená diplomová práce zpracovává tematiku forenzního účetnictví a hospodářské kriminality na území České republiky. Klíčovým důvodem, který přispěl k rozhodnutí ke zpracování právě tohoto tématu, je jeho neustálá aktuálnost odrážející se v první řadě ve významném každoročním počtu registrovaných trestných činů, které naplňují znaky hospodářské trestné činnosti. Aktuálnost současně tkví ve skutečnosti, že díky pokroku v oblasti technologií se na druhou stranu zároveň rozšiřuje pole působnosti a naskýtají se nové možnosti subjektům, kteří proti mnohým z těchto nebo obdobným činům bojují a jejich počty se snaží buď svými preventivními aktivitami eliminovat, nebo následně objasnit. Řeč je mimo jiné o účetních, kteří působí v oblasti známé jakožto účetnictví forenzní, jež se vyznačuje porozuměním právnímu procesu, schopností vést vyšetřování a současně prováděním finančních analýz a dalších účetních postupů, a to na úrovni, kterou je možné považovat za přijatelnou právním systémem. Hlavním výstupem práce jsou přitom rozhodnutí o potvrzení nebo vyvrácení formulovaných hypotéz, které se zaměřují na vzájemné vztahy mezi zjištěnými hospodářskými trestnými činy, veškerými registrovanými trestnými činy a podnikatelskými účetními jednotkami, které působí na území České republiky.

Abstract:

The submitted master's thesis deals with the topic of forensic accounting and economic criminality in the Czech Republic. The key reason which contributed to the decision to compile this topic is its constant relevance. This relevance is primarily reflected in the significant annual number of registered crimes fulfilling the characteristics of economic criminality. At the same time, the topic is still relevant thanks to advanced technologies. Advances in technology expand the scope and generate new opportunities for those who fight many of these or similar acts and try to eliminate their numbers or subsequently clarify these acts. These people are, among others, accountants who are working in the area which is known as forensic accounting. Forensic accounting is characterized by the understanding of the legal process, the ability to conduct investigations and to perform financial analysis and other accounting procedures at a level which can be considered acceptable by the legal system. The main output of the submitted thesis are decisions to confirm or to disprove the formulated hypotheses which focus on the interrelationships between the registered economic crimes, all registered crimes and business entities operating in the Czech Republic.
