Permanent Residence at the Municipal Registration Office

Abstract:

Tématem této práce je trvalý pobyt na ohlašovně obce. Stručně popisuje právní úpravu a také orgány vykonávající správu na úseku evidence obyvatel. Zabývá se již neexistujícím přechodným pobytem a podrobněji vymezuje institut trvalého pobytu. Následně je popsána problematika základních registrů a doručovací adresy. Převážná část práce je věnována důvodům trvalého pobytu na ohlašovně obce a blíže je specifikováno správní řízení ve věci zrušení údaje o místu trvalého pobytu. Poslední část práce je zaměřena na důsledky trvalého pobytu na ohlašovně obce v návaznosti na některé právní předpisy. Práce poukazuje na potřebná chybějící ustanovení v zákoně o evidenci obyvatel, jež je stěžejním právním předpisem v této oblasti.

Abstract:

The theme of this work is a Permanent Residence at the Municipal Registration Office. It briefly describes the legislation and authorities administering the registration section of the population. It deals with the non-existent temporary residence and further defines the institute of permanent residence. Consequently the issue of national registers and delivery address is described. The bulk of the work is dedicated to the reasons of Permanent Residence at the Municipal Registration Office and the administrative procedure in case of abolishment of the indication of the place of residence is specified more closely. The last part is focused on the consequences of Permanent Residence at the Municipal Registration Office in relation to certain legal enactments. The work refers to the lack of necessary provisions in the Law on the population register, which is a major legal enactment in this field.
