The Child Is Not An Object. Philosophical and Legal Analysis of the Problem

Abstract:

Tato diplomová práce se zabývá problematikou ochrany práv dětí v České republice. Snaží se ukázat především právní pojetí dítěte v českém právním prostředí. Ochranu práv dětí monitoruje v institutech péče rodiče o dítě a vyživovací povinnosti, což jsou oblasti, ve kterých často dochází k chápání dítěte jako objektu, nikoliv subjektu. Práce vymezuje samotné dítě z pohledu několika společenských věd a vývoj chápání dítěte na českém území. V hlavní části rozebírá právní zakotvení vybraných institutů, které v poslední kapitole aplikuje na reálné právní případy.

Abstract:

This thesis deals with the issue of protection of the rights of children in the Czech Republic. It focuses on the legal definition of a child in the Czech regulatory environment. It monitors the protection of the rights of children in the institutes of child custody and maintenance obligation. In these two areas, it often occurs that the child is understood as an object, not as a subject. The thesis focuses on defining the child from the perspective of several social sciences and on the development of understanding the child in the Czech Republic. The main part of the thesis examines the legal status of the institutes; these are then applied on real-life legal cases in the last chapter.
