The course of civil litigation

Abstract:

Bakalářská práce nese název "Průběh civilního řízení sporného". Hlavním cílem práce je analyzovat problematiku průběhu civilního sporného řízení a rozebrat jednotlivé fáze. Teoretická část začíná objasněním pojmu žaloba, čímž se zahajuje civilní sporné řízení. Dále analyzuje obsah a náležitosti žaloby a ostatní náležitosti, které mají na průběh řízení vliv. Následuje pozitivní a negativní vymezení podmínek řízení. V další části je analyzován pojem příprava jednání a samotné jednání přípravné, včetně výzev k vyjádření. Práce pokračuje kapitolou o jednání, od samotného zahájení po skončení jednání, na tuto kapitolu navazuje kapitola vydání rozhodnutí. Praktická část obsahuje fiktivní kazuistický případ vztahující se k této problematice cílem je sledování možného vývoje případu od samotného uzavření smlouvy až k soudnímu vymáhání.

Abstract:

The title of the thesis is called "The course of civil litigation". The main goal of this bachelor's thesis is to analyze the issues and various stages of civil litigation. Bachelor thesis begins with an explanation of the concept of action, which initiates civil litigation. It further analyzes the content and requisites of the lawsuit and other requisites that affect the course of the proceedings. This is followed by a positive and negative definition of the procedure conditions. In the next section, I analyze the concept of preparation of the hearing and the preparatory hearing itself, including calls for comments. I am continuing with the important chapter, which is the proceedings from the very beginning to the end of the proceedings, and I am following up this chapter with the chapter of the judgment. I conclude the thesis with a fictitious casuistic case of this issue, the aim of which is to monitor the possible development of the case from the conclusion of the contract itself to judicial enforcement.
