Soldiers’service relation and labour-law relations concerning civil employees of Ministry of Defence of the Czech Republic

Abstract:

Abstrakt Tato diplomová práce se zabývá problematikou pracovně právních vztahů zaměstnanců jednoho z klíčových ministerstev bezpečnostních sil našeho státu – resortu Ministerstva obrany. Je rozčleněna na tři základní části. V části první se detailně zabývá služebním poměrem vojáků z povolání ve smyslu jejich „služebního zákona“, jeho specifikami a problémy, jež z ustanovení tohoto zákona pro práci vojáků vyplývají. V jednotlivých podkapitolách zkoumá proces vzniku, průběhu a zániku služebního poměru vojáků, zabývá se specifiky jednotlivých fází služebního poměru, rozebírá detailně nevýhody služby vojáků z hlediska jak služby v mírovém životě, tak při nepřetržitém výcviku a cvičení, jakož i problematikou nasazení v zahraničních misích. Současně podrobně rozpracovává výhody tohoto služebního poměru, především z hlediska nároků vojáků jak v průběhu služby, tak po ukončení služebního poměru. Ve stati jmenování do vyšší hodnosti a obsazování systemizovaného místa rozpracovává současný největší problém resortu obrany, a to otázky kariéry vojáka a neexistenci Kariérního řádu armády. V druhé části práce jsou rozpracovány základní způsoby vzniku a průběhu pracovního poměru občanských zaměstnanců v resortu obrany. Obsáhleji v této části práce jsou popsány především otázky „Kolektivní smlouvy“, platné v resortu pro práci občanských zaměstnanců, a to výhody, jež byly pro průběh pracovního poměru odborovými organizacemi získány. Dílčím způsobem jsou rozpracovány problémy kariéry této kategorie zaměstnanců resortu obrany, především z hlediska nenabytí účinnosti zákona č. 218/2002 Sb., o službě státních zaměstnanců. V poslední části práce jsou pak rozpracovány konkrétní praktické příklady z aplikace ustanovení Zákoníku práce a zákona č. 221/1999Sb., o vojácích z povolání, zaměřené hlavně na správnost či nesprávnost použití ustanovení uvedených zákonů při řešení průběhu služebního a pracovního poměru obou kategorií zaměstnanců.

Abstract:

This dissertation deals with issues concerning labour-legal relations of employees from one of the key ministries of security forces of our state - Ministry of Defence. It is divided into three basic parts. In the first part it deals with the service relations of professional soldiers in detail in accordance with their "service law", it describes their specifics and problems which result from the provision of the statute for the work of soldiers. In particular sub-chapters it examines the process of the origin, continuance and abolishment of the service relations of soldiers, it inquires into the specifics of particular periods of service relations, it analyses the disadvantages of soldiers' service in detail in light of both service in peace times and during continual training and military exercises, it is also concerned with the issues of being stationed in missions abroad. At the same time it goes into the advantages of this service relations closely, mainly from the point of view of the demands of soldiers both in the course of service and after the termination of service relations. In the part the appointment to a higher grade and the filling of an established post it analyses the biggest current problem of Ministry of Defence which is a question of soldiers' careers and the absence of career rules of the army. In the second part of this dissertation basic ways of origin and continuance of employment of civil employees at the Ministry of Defence are examined. Especially the questions of "Collective Agreement" valid at the ministry for the work of civil employees are described in this part of work extensively - advantages which were gained for the process of employment by trade unions. Some problems concerning career of this class of employees of the Ministry of Defence are dealt with in a partial way, especially from the point of view of not coming into force of the law No.218/2002 Sb. about state employees service. In the last part of the work particular practical examples of usage of provision of the statute concerning the Labour Code of Law and the law No. 221/1999 Sb. about professional soldiers are examined. They are focused mainly on justice or injustice of using provision of the statute concerning the above mentioned laws when dealing with process of service relations and employment of both categories of employees.
