Particular problems of aplication of the title V, part third of code of criminal procedure in police practice

Abstract:

Předkládaná práce se zabývá teoreticky i prakticky aplikací ustanovení §104a – 104e trestního řádu České republiky v práci Služby kriminální policie a vyšetřování Policie České republiky. Tato ustanovení se týkají zvláštních způsobů dokazování – konfrontace, rekognice, vyšetřovací pokus, rekonstrukce, prověrka na místě. Autor v úvodu práce nejprve čtenáře uvádí do probírané problematiky definicí užívaných pojmů, k čemuž užívá přehledné rozdělení jednotlivých výrazů do kapitol: trestní řízení, policejní praxe, dokazování. Tato část práce může být označena jako teoretická, autor v ní těží z odborné literatury, uvádí citace a připojuje k nim svůj názor. Podrobně rozebírá jednotlivá ustanovení trestního řádu, která mají podstatný význam ve vztahu k zaměření práce. V následujících kapitolách se již detailně věnuje hlavnímu tématu – zvláštním způsobům dokazování. Nejprve uskuteční nastínění historie v oblasti užívání těchto specifických metod v procesu dokazování v časovém horizontu od vzniku samostatné Československé republiky roku 1918 až do současnosti. Následuje jednoduchý průzkum mezi 25 zkušenými policisty z úseku vyšetřování, na jehož výsledcích ukazuje, že nejčastěji používaným zvláštním způsobem dokazování je rekognice a vysvětluje, že z toho důvodu bude rekognici věnována podstatná část práce. Dalšími kapitolami pak podrobně probírá jednotlivé způsoby dokazování v policejní praxi. Používá k tomu systém subkapitol: trestně procesní hledisko, kriminalistické hledisko, vyplývající problémy (pro policejní praxi), příkladná kazuistika. V subkapitolách hledisek opět užívá jako pramenů odbornou literaturu a užívá citace, v subkapitolách vyplývající problémy a kazuistika již vychází z vlastní praxe. U každého zvláštního způsobu dokazování popisuje podrobně příklad z praxe a demonstruje na něm možné problémy. U jednotlivých problémů dospívá stručně řečeno k těmto závěrům: konfrontace je v trestním řádu upravena vzhledem k policejní praxi bezkonfliktně, problémy vznikají při praktickém provádění úkonu, jsou tedy taktického rázu. Jinak je tomu u rekognice. Zde autor objevuje mnoho problémů. Stručně jde o problémy spojené s obtížnou vynutitelností účasti obviněného v rekognici, možnosti uskutečnit tzv. skrytou rekognici, nemožnosti odměňování dobrovolníků, kterých je ke zdárnému provedení rekognice třeba, nemožnost omezit manipulaci s vizáží obviněného do doby provedení rekognice a přísné podmínky možnosti nahradit rekognici in natura rekognicí dle fotografií. U zvláštních způsobů dokazování – vyšetřovací pokus, rekonstrukce, prověrka na místě autor zmiňuje, že v praktické aplikaci těchto zákonných ustanovení v policejní praxi nedochází k žádným problémům, zákonná formulace je vůči praxi vstřícná. Jediné problémy u těchto způsobů dokazování jsou takticky – technického rázu a policisté se s nimi dokáží vypořádat. V závěru práce uvádí, že zdaleka nepostihl všechny problémy policejní praxe, ale práce může být přínosem pro policisty a právníky v orientaci v problematice.

Abstract:

Hereby presented work entitled Particular Problems of Aplication of the Title V, Part Third of Code of Criminal Procedure in Police Practice focuses on both theoretical and practical aplication of the §104a – 104e of the Criminal Procedure Code of the Czech republic and its use at the Service of Criminal Police and Investigation of the Czech republic. These articles serve mainly as a way of implementation of specific methods of investigation, such as confrontation, recognition, investigative test, reconstruction and verification on crime scene. The author starts with definition of used terminology, while for this purpose is his work divided into chapters, which deal with individual terms one by one. The chapters go as follows: criminal procedure, police practice, gathering of proofs. This part of the work is mainly theoretical, since the author draws from scientific literature, quotes from the sources and explains his standpoint. Relevant individual articles of the Criminal Procedure Code are closely examined here. Other chapters cover in detail the main topic of this work - e.i. specific methods of investigation. At the beginning there is a brief history of the use of these methods from the constitution of independent Czechoslovak state in 1918 till today. This part is followed by basic research, whose respondents were 25 police officers - experienced investigators. In the light of this research the author shows, that if we have a close look at the specific methods of investigation, we find, that the one most frequently used is recognition. He also offers an explanation why is it so and for the same reasons takes recognition prominent part of the work. Other chapters are devoted to detailed analysis of individual methods of above mentioned specific methods of investigation and their use in police practice. For this purpose are individual chapters further subdivided into shorter units, namely: criminal procedure viewpoint, criminalistic viewpoint, its obstacles (prom the police point of view), case analysis. The above mentioned subdivisions also draw form scientific literature a quotes listed sources, obstacles from the police point of view and case analysis is based on authors personal experience. Each specific method of investigation is paired with an eample from police practice, while every such example serves also as a demonstration of possible problems. In short, close look at these problems leads to following conclusions: there is no discrepancy between confrontation as it is described in the Criminal Procedure Code and its implementation in the police practice. The only problems might occur during the confrontation as such, which means that they are tactical rather than theoretical. Alas, this conclusion looses its validity with regard to recognition. The author here points at numerous problems. Saying in brief, person accused of a crime cannot be forced to take part in the recognition, the possibility of realisation of so called secret recognition is restricted, there is no possibility of financial payment of the indispensable volunteers, it is impossible to force the accused person to keep constant physical look for the purpose of recognition, and last but not least strict regulations, under which can be recognition in nature replaced by recognition based on photographs. With regard to such specific methods of investigation as investigative test, reconstruction and verification on crime scene the author notes, that there are no problems of practil application of these methods in the police practice, since these articles are formulated in a sufficiently open way. The only problems in this field draw from tactical or technical causes and as such they can be eliminated by the police officers. In his conclusion the author admits that he did not cover all problems occuring in the police practice, but nevertheless his work can be helpful for those police officers and lawyers, who seek basic orientation in this topic.
