Abstract:

Diplomová práce na téma „Kategorizace právnických osob“ se po úvodním pojednání o pojmu, vývoji v historickém kontextu a pojetí v rámci různých teoretických koncepcí právnických osob, soustředí na kategorizaci právnických osob soukromého a veřejného práva. Kategorizace je provedena na základě čtyř kritérií, kterými jsou povaha a míra ingerence zákonodárce na vznik právnických osob a zaměření jejich činnosti, charakteristika faktického základu právnické osoby, účel jejich založení a rozsah působnosti příslušné normy, v jejímž režimu právnické osoby mají svůj původ. Práce je systematicky doplněna o aktuální českou judikaturu a judikaturu Evropského soudního dvora.

Abstract:

The diploma thesis “the Categorization of legal persons“ is divided into two parts – the general part and the special part. The general part is focused on a term of legal entity, the evolution of legal persons in the historical context, various theories of legal persons, the current description de lege lata as well as the proposed future description de lege ferenda. The special part deals with the categorization. Four criteria are chosen to achieve the main aim of this work, which is to systematically sort and categorize legal persons of the public law as well as the private law. The diploma work is completed with some practices of courts and adjudications as well as judicature of the European Court of justice in connection with legal entities.
