Securing payment of taxes

Abstract:

Předkládaná disertační práce se zabývá problematikou zajištění daní jako zvláštní výsečí daňověprávních vztahů. V první části práce jsou popsány daňověprávní vztahy obecně a podstata zajištění daní zvlášť. Druhá část práce je věnována jednotlivým zajišťovacím institutům, tedy zajišťovacímu příkazu, zástavnímu právu, ručení a finanční záruce, zvláštnímu způsobu zajištění daně, zálohám a kaucím. Cílem práce je objasnit podstatu a účel jednotlivých institutů zajištění daní a podmínky, za kterých mohou být využity či modifikovány v praxi.

Abstract:

The thesis addresses the issue of tax security as a special section of the legal tax relations. The first part of the thesis describes the tax legal relations in general and the essence of securing performance of taxes in particular. The second part of the thesis is devoted to individual securing institutes, i.e. securing order, lien, surety and financial guarantee, special method of tax securing, advance payments and deposits. The aim of the thesis is to explain the nature and purpose of individual tax security institutes and the conditions under which they can be used or modified in practice.
