Abstract:

Výkon matriční agendy je výkonem státní správy, který prošel dlouhým historickým vývojem. Matriční činnost se zabývá matrikami, které jsou státní evidencí narození, uzavření manželství a úmrtí fyzických osob, nově i evidencí uzavření registrovaného partnerství. Matriky, duplikáty matrik a doklady z nich vydané, jsou veřejnými listinami, osvědčující osobní stav občana. Po reformě veřejné správy, v jejímž rámci byla působnost a pravomoc na úseku matrik a státního občanství bývalých okresních úřadů rozdělena mezi úřady krajské a úřady obcí s rozšířenou působností, nyní vykonávají působnost na úseku matrik matriční úřady, úřady obcí s rozšířenou působností, krajské úřady a Ministerstvo vnitra České republiky. Problematika matriční činnosti a záležitostí, s ní souvisejících, je tématem mé práce. Tato práce podává přehled o výkonu matriční agendy a některých agend, souvisejících podle právních předpisů, platných a účinných zejména od roku 2001, kdy nabyla účinnosti nová právní úprava – nový zákon o matrikách. Způsoby vedení matrik, listinných sbírek, technika jednotlivých zápisů, matriční doklady a vše, co s matrikami souvisí, se neustále vyvíjí. Matriční činnost, která sahá hluboko do minulosti, prochází neustálým vývojem a modernizací, stejně, jako svět kolem nás. Přínosem této práce je ucelený přehled současné matriční agendy, shrnutí práv a povinností všech účastníků při řízení v matričních záležitostech. Jsou zde zmíněny i problémy, vycházející z vlastní konkrétní praxe, jejich řešení a návrhy na případná zlepšení.

Abstract:

The activity performed by the registrar´s authorities constitutes the exercise of state administration which has a long historical background. The registrar´s authorities serves to keep record of the births, solemnized marriages, deaths and recently also of the registered partnership. The documents issued by registrar´s authorities are public documents certifying the personal status of a person. As a result of the reform of public administration which transferred the authority and responsibility for registration activity and citizenship from former district authorities to regional and local authorities with extended powers, the registration activity is nowadays performed by registrar´s authorities, local authorities with extended powers, regional authorities and Ministry of Interior. My thesis focuses on the topic of registration activities and the aspects linked to it. My thesis gives a survey on the exercise of registration activity and some related activities in accordance with legal regulations that took effect especially after 2001 when a new legislation on registrar´s authorities became effective. The way of keeping the registration books, collections of deeds, technique of entries, registration documents and all aspects linked to the registrar´s authorities is permanently developing. The registration activity which started a very long time ago, is all the time undergoing a process of changes and modernization as the world around us. The contribution of this thesis consists in the survey of present registration activity summarizing the rights and obligations of all the parties during the proceedings related to the registration matters. The author states some issues resulting from her own practical experience, as well as the solutions and suggestions for possible improvement.
