Regulation of Lobbying in Slovakia: History of Attempts and Analysis of Current Trends

Abstract:

One of the fundamental features of liberal democratic systems is the existence of diverse interests that seek to influence government decisions. There is therefore no surprise that the activities of organized interests present a natural and legitimate part of democratic processes. Nevertheless, we look at the lobbyists with considerable skepticism and the concept of lobbying has often got a negative connotations. This situation has been caused mainly by the gradual increase of the number and by growing diversification of organized interests that often act in informal or unfair way, thus the movement of players within the playing field becomes less clear and transparent. Trying to distinguish lobbying from corruption or other illegal ways of influencing public officials has led many countries toward efforts to streamline the playing field and processes that occur in it. The fulfillment of these efforts is the introduction of regulation of lobbying, which may be achieved by using various tools. The aim of this thesis is to map the attempts of Slovak government to establish rules governing the behavior of organized interests in the Slovak Republic. Author's aim is also to analyze society-wide context which affected the destiny of the proposals, as well as assess what are the mood and preferences of the particular actors to the issue of regulating lobbying in Slovakia.

Abstract:

Jedným zo základných prvkov liberálne demokratických systémov je existencia rôznorodých záujmov, ktoré sa usilujú o ovplyvnenie vládnych rozhodnutí. Nie je preto žiadnym prekvapením, že činnosť organizovaných záujmov je prirodzenou a legitímnou súčasťou demokratických procesov. Napriek tomu na lobistov nazeráme so značnou nedôverou a pojem lobing má často negatívne konotácie. Tento stav má na svedomí predovšetkým postupné navyšovanie počtu a rastúca diverzifikácia charakteru jednotlivých záujmov, ktoré nezriedka jednajú neformálnymi či nekalými spôsobmi, čím sa pohyb aktérov v rámci hracieho poľa stáva menej prehľadným a netransparentným. Snaha odlíšiť lobing od korupcie či iných nezákonných foriem ovplyvňovania verejných činiteľov vedie už niekoľko desaťročí jednotlivé štáty k úsiliu o sprehľadnenie hracieho poľa a procesov, ktoré sa v ňom odohrávajú. Reálnym naplnením týchto snáh je zavádzanie regulácie lobingu, ku ktorej môže dochádzať za použitia viacerých nástrojov. Táto práca si kladie za úlohu zmapovať doterajšie pokusy slovenskej vlády o vytvorenie pravidiel regulujúcich správanie organizovaných záujmov na území Slovenskej republiky. Autorkiným cieľom je následne analyzovať celospoločenský kontext, ktorý ovplyvnil osud daných návrhov, ako i zhodnotiť, aké nálady a preferencie zastávajú k problematike regulácie lobingu na Slovensku jednotliví zainteresovaní aktéri.
