Collation from a Historical Comparative Perspective

Abstract:

Práce se zabývá institutem kolace (započtení na povinný díl a dědický podíl) v jeho historickém vývoji. Hlavními otázkami jsou, zda institut započtení čerpá z římskoprávní úpravy a jak se současná právní úprava liší od těch předešlých. Při zpracování bylo vycházeno z pramenů (právních předpisů a dobové judikatury) a z dobové literatury. V práci jsou nejdříve vymezeny základní pojmy. Následně je představen historický vývoj od římského práva přes rakouský obecný zákoník občanský až po současnou právní úpravu. Nakonec je provedeno srovnání vybraných institutů spojených s problematikou kolace.

Abstract:

This diploma thesis focuses on the institute of the collation in terms of its historical development. The main questions are whether the institute of collation draws from Roman law regulation and whether the current regulation is different from the previous ones. The elaboration is based on legal sources (legal regulations and contemporary jurisprudence) and contemporary literature. The first part of this thesis introduces the fundamental terms, then proceeds to analyse and compare historical development from Roman law through the Austrian General Civil Code to the current one. Finally, a comparison of selected institutes associated with the institute of collation is made.
