Proceedings in the Matters of Children Under Fifteen Years of Age Who Committed an Act Which Is Otherwise a Criminal Offence

Abstract:

Cílem této práce je poznat právní úpravu řízení ve věcech dětí mladších patnácti let, které se dopustily činu jinak trestného, a vytýčit problémy, se kterými se lze v praxi setkat. Úvodem jsou vymezeny základní pojmy trestního práva, potom se práce zaměřuje na kriminalitu dětí mladších patnácti let z pohledu kriminologie a rozvádí základní trestně politické přístupy k zacházení s delikventními dětmi. Dále jsou zmíněny relevantní mezinárodní dokumenty, které ovlivňují českou právní úpravu i úvahy de lege ferenda. Následně je analyzována česká právní úprava řízení ve věcech dětí mladších patnácti let. Analýza se nejprve zaměřuje na historický vývoj této právní úpravy, následně je uvedena charakteristika zákona o soudnictví ve věcech mládeže, a konečně je analyzován postup orgánů činných v trestním řízení a soudu pro mládež poté, co dojde ke spáchání činu jinak trestného dítětem mladším patnácti let, a opatření, která je možné trestně neodpovědným dětem uložit. Výsledkem práce jsou úvahy de lege ferenda.

Abstract:

The aim of this thesis is to learn about the legislation on the proceedings in the matters of children under fifteen years of age who committed an act which is otherwise a criminal offense and name the problems we can encounter in practice. First, it defines the elementary terms of criminal law, and then it focuses on the criminality of children under fifteen years of age in the criminology viewpoint and on the primary juvenile justice systems. Furthermore, relevant international documents influencing the Czech legislation and considerations de lege ferenda are mentioned in the thesis. Subsequently, the Czech legislation on the proceedings in the matters of children under fifteen years of age is analysed. Initially, the analysis is focused on historical evolution of this legislation, then on the characteristic of the Act on Juvenile Justice, and, at last, on the proceeding of the bodies active in criminal proceedings and the juvenile court, after an act which is otherwise a criminal offense was committed. The thesis results in reflections de lege ferenda.
