The Acte Clair Doctrine

Abstract:

Tato diplomová práce se zabývá institutem předběžné otázky se zaměřením na doktrínu acte clair. Stěžejní část práce spočívá v analýze doktrinálního a judikaturního vývoje kritérií Cilfit se zaměřením na výkladová vodítka stanovená pro doktrínu acte clair v rozsudku Cilfit. Práce si dává za cíl vyhodnotit, jakým způsobem má národní soud postupovat, a co vše musí národní soud zohlednit, aby mohl rozhodnout, že o výkladu unijního práva neexistují žádné rozumné pochybnosti. Práce se také zabývá odůvodněním rozhodnutí národních soudů o nepoložení předběžné otázky

Abstract:

This thesis concerns the institution of the preliminary reference focusing on the doctrine of acte clair. The core of the thesis involves an analysis of the doctrinal and jurisprudential development of the Cilfit criteria focusing on the interpretive guidelines set out for the acte clair doctrine in the Cilfit judgment. The aim of the thesis is to evaluate how national courts should proceed and what the national court shall consider assessing that the interpretation is so obvious that there is no reasonable doubt as to the interpretation of EU law. The thesis further elaborates on the statement of reasons for the decision of national courts not to make a preliminary reference.
