Abstract:

Tato bakalářská práce se zabývá popisem a obecnou analýzou živnostenského podnikání v České republice. Na začátku práce je rozebrán pojem podnikání a živnostenské podnikání, následující kapitola popisuje historický vývoj živnostenského podnikání po přijetí dnes platného živnostenského zákona. Další kapitoly se snaží vysvětlit základní instituty živnostenského zákona, rozsah živnostenského oprávnění a povinnosti podnikatele. Další část je věnována vzniku, změně a zániku živnostenského oprávnění, živnostenské kontrole a přestupkům. Na konci práce jsou uvedeny úvahy de lege ferenda.

Abstract:

This bachelor thesis deals with the description and general analysis of trading in the Czech Republic. At the beginning of the work is analyzed the concept of business and trade business, the following chapter describes the historical development of the trade business after the adoption of the valid Trade Licensing Act. The next chapters try to explain the basic institutes of the Trade Licensing Act, the scope of the Trade License and the obligations of the entrepreneur. The next part is devoted to the Trade authoriation and its establishment, amendment and termination, trade licensing control and administrative delicts. At the end of the thesis are given de lege ferenda considerations.
