Trust Succession according to the New Civil Code

Abstract:

Diplomová práce pojednává o úpravě svěřenského nástupnictví podle nového občanského zákoníku. Cílem je tento institut analyzovat a vysvětlit za pomoci různých příkladů. Z tohoto důvodu jsou použitými metodami analýza a srovnání. Začátek práce je věnován historickým souvislostem. Hlavní kapitola se zabývá samotnou analýzou svěřenského nástupnictví a různými problémy, které z této úpravy mohou plynout. Závěrečná kapitola zvažuje možné pozitivní a negativní stránky věci. Diplomová práce vychází především z úpravy institutu v novém občanském zákoníku a obsahuje mnoho osobních názorů.

Abstract:

This thesis deals with the regulation of the Trust Succession according to the new Civil Code. The purpose is to analyze and explain this institute through various examples. Therefore the methods of analysis and comparisons are used. The beginning of the thesis is devoted to the historical context. The main chapter deals with the Trust Succession analysis itself and with possible problems of this regulation. The final chapter contains the possible positive and negative sides of the institute. This thesis is mainly based on the regulation of the new Civil Code and includes many personal opinions.
