Interpretation of Bill of Exchange Text

Abstract:

Předmětem této diplomové práce je analýza rozhodnutí ve směnečných věcech, která se týkají interpretace textu směnky, resp. jejího prostorového uspořádání. V první části nalezneme druhy interpretace právního jednání se zaměřením na specifika interpretace textu směnky a jejich projevy v souvislosti se směnečnou přísností. Druhá část práce je věnována analýze směnečných rozhodnutí ve věcech interpretace textu směnky. Do této části se řadí interpretace směnečných náležitostí, problematika aplikace podpůrných údajů ve směnce, fakultativní pravdivost údajů ve směnce a grafické uspořádání směnečných náležitostí. Součástí jednotlivých kapitol je komparace soudní interpretace s názory vyjadřovanými v odborné literatuře.

Abstract:

The main topic of my diploma thesis is the analysis of judicial decision in bill of exchange cases which deals with interpretation of its text, respectively its order (spatial distribution, settings). In the first part we can find various types of interpretation of legal performance focusing on specifics of such interpretation in case of bill of exchange and their expressions in connection with bill of exchange stringency. The second part of my diploma thesis is dedicated to the analysis of bill of exchange case law concerning the interpretation of bill of exchange text. This part includes also interpretation of bills of exchange essentials, the issue of the application of supporting data in the bill of exchange, optional verity of dates included in the bill of exchange and also the graphical layout of respective elements. Each part of the chapter includes the comparison of judicial interpretation together with various opinions presented in the literature.
