Analysis of the Jurisprudence of the CJEU in Matters of Determining International Jurisdiction of Courts in cases of Defamation and Violation of Personality Rights on the Internet

Abstract:

Tato diplomová práce se zabývá problematikou určování mezinárodní příslušnosti soudů v případech pomluvy a porušení osobnostních práv na internetu. Práce poskytuje podrobnou analýzu článku 4 a 7 odst. 2 Nařízení Brusel I bis obsahující kritérium „místo škodné události“. Zabývá se jak otázkou určení mezinárodní příslušnosti, tak především analýzou rozhodnutí Soudního dvora Evropské unie ve věcech Shevill, eDate, Bolagsupplysningen, Mittelbayerischer Verlag KG a nejnovější rozhodnutí Gtflix TV. Uvedená rozhodnutí jsou podrobena kritické analýze s ohledem na povahu šíření informací na internetu a účelnosti této interpretace v rámci principů Nařízení Brusel I bis.

Abstract:

This diploma thesis deals with the issue of determining the international jurisdiction of courts in cases of defamation and violation of personality rights on the Internet. The thesis provides a detailed analysis of Articles 4 and 7 (2) of the Brussels I bis Regulation containing the criterion “place of harmful event”. It addresses both the question of determining international jurisdiction and, in particular, an analysis of the decisions of the Court of Justice of the European Union in the Shevill, eDate, Bolagsupplysninhen, Mittelbayerischer Verlag KG and the most recent Gtflix TV decision. These decisions are subjected to a criti-cal analysis with regard to the nature of the dissemination of information on the Internet and the appropriateness of this interpretation within the framework of the principles of the Brussels I bis Regulation.
