Suitability of Execution and Protection of Obliged Person in Executory Proceeding

Abstract:

Cílem této práce je poukázat na práva povinného, jeho postavení v exekučním řízení a vymezení prostředků zákonné ochrany a obrany. Stěžejní otázkou je pak přiměřenost exekucí. Základem je obecný popis, analýza zákonných prostředků obrany a ochrany povinného s důrazem na vymezení rozdílů a jejich účelu. První část práce se věnuje exekuci a výkonu rozhodnutí obecně, vymezuje zásady exekučního práva, hlavní pojmy a instituty související s tématem práce a zkoumá změny, které přináší nově rozšířená pravomoc exekutorů v důsledku zásadní právní úpravy účinné od 1. 1. 2013. Druhá část se zaměřuje na exekuční řízení, přičemž největší pozornost je věnována podrobnější studii, vymezení a posouzení exekučních sporů, žalob a prostředků obrany a ochrany povinného. Kriticky hodnotí platnou právní úpravu s cílem poukázat na nedostatky a podává návrhy změn. Součástí je komparace české a slovenské úpravy exekučního práva.

Abstract:

The aim of the diploma thesis is point out the rights of the debtor, his position in the execution proceeding and specify the means of legal protection and defense. The key issue is the adequacy of the execution . The basis is a general description, analysis of legal means of defense and protection, their purpose and differences between them. The first part look into the execution and enforcement of judgments in general , defines the principles of law of enforcement , the main concepts and methods related to the theme of thesis, and explores the changes brought by the amendment on the 1th January 2013. The second part focuses on the execution procedure , the most attention is devoted to detailed study, definition and appraisal of executory disputes, claims and means of defense and protection of debtor. Critically appraises the current legislation in order to point out the shortcomings and propose changes. Compare the Czech and Slovak regulations of law of enforcement.
