Government Bonds in the Czech Republic

Abstract:

Hlavním cílem diplomové práce je vyhodnotit vybrané aspekty státních dluhopisů z hlediska právního a ekonomického, a to prostřednictvím analýzy vybraných emisí státních dluhopisů z pohledu příjmu státního rozpočtu, ale i potenciálního zisku pro investora. Dílčím cílem je identifikace teoretických i praktických aspektů aktuální právní úpravy státních dluhopisů. Pro účely splnění hlavního i dílčího cíle diplomové práce byla provedena rozsáhlá literární rešerše, právní analýza relevantních právních předpisů týkajících se vydávání a obchodování se státními dluhopisy, analýza ochrany investora a práv držitelů státních dluhopisů, ekonomická analýza a v neposlední řadě srovnávací analýza (přístupů a praktik ve vybrané zemi). Z hlediska ochrany investorů a zajištění spravedlivých a transparentních podmínek na trhu je vhodné zvážit posílení regulace vydávání dluhopisů. De lege ferenda autor diplomové práce navrhuje právní úpravu v oblastech transparentnosti a dostupnosti informací, ochrany investora, diverzifikace portfolia, transparentním a efektivním emisním procesu a rovněž inovace a flexibility.

Abstract:

The main objective of the thesis is to evaluate selected aspects of government bonds from the legal and economic point of view, through the analysis of selected issues of government bonds in terms of state budget revenue, but also potential profit for the investor. A sub-objective is to identify the theoretical and practical aspects of the current legal regulation of government bonds. In order to meet the main and sub-objectives of the thesis, an extensive literature search, legal analysis of relevant legislation on the issuance and trading of sovereign bonds, analysis of investor protection and rights of sovereign bond holders, economic analysis and last but not least a comparative analysis (of approaches and practices in the selected country) were carried out. In terms of investor protection and ensuring fair and transparent market conditions, it is appropriate to consider strengthening the regulation of bond issuance. De lege ferenda, the author of the thesis proposes regulation in the areas of transparency and availability of information, investor protection, portfolio diversification, transparent and efficient issuance process as well as innovation and flexibility.
