The Evolution of Advocacy and justice in England, Scotland and Ireland in Victorian era

Abstract:

Touto rigorózní práce jsem se pokusil navázat na svou diplomovou práci, ve které jsem se věnoval advokacii a justicii ve Viktoriánské Anglii a rozšířit ji o Skotsko a Irsko. Svou práci jsem začal shrnutím vývoje těchto povolání před viktoriánským obdobím, kde je již patrné, jak se Anglie snažila ovlivňovat a podmanit si tyto dvě země. Hlavně tedy Irsko se počátkem 19. století snažilo vzdorovat různě velkými revolucemi a hlavně tím, že měla své vlastní vzdělávací instituce pro advokáty. Stejně tomu tak bylo i u Skotska. Značnou část práce věnuji významným soudcům a advokátům a to i v Anglii, kde na hlavně na soudce nezbyl již prostor. Za doby vlády Viktorie se Anglie stala světovou velmocí, vývoj justice a advokacie s sebou přinesla spoustu změn a významné sjednocení systému. Převrat ve zjednodušení justice přinesla reforma Judicature Act (1873 - 1875) jako první krok ke sjednocení a modernizaci soudů. Ve viktoriánském období se dále vyvíjí advokacie a dochází k jejímu dalšímu ukotvení v právním systému. Její dvě hlavní části - barristři a solicitoři, jsou dodnes nedílnou součástí práva Velké Británie. Rozdíl mezi anglickým a kontinentálním právem je značný. Anglické právo není založeno na používání zákona jako prvotního pramene práva tak, jak je tomu u práva kontinentálního. Primárním je používání práva soudcovského (common law a equity) a precedentů. I v Anglii ovšem platí řada zákonů, ať již historicky zachovaných či současných. Soudní precedenty tedy nejsou výlučným pramenem práva, ovšem pro právní systém mají podstatný význam. Anglie si své specifické postavení justice a advokacie zachovala až do dnešní doby. Je kladen důraz na historický vývoj a zachování hierarchie justice. V advokacii jsou dodnes důležité instituce The Bar Council a The Law Society. Právní systém je historicky značně významný a v rámci Evropy velice charakteristický. Cílem této práce bylo vytvořit ucelený přehled vývoje právní úpravy od doby průlomových změn viktoriánského období, kdy takovéto shrnutí by mohlo být nejen zajímavé, ale i přínosné pro rozšíření přehledu v další spolupráci s Velkou Británií.

Abstract:

With this rigorous thesis, I tried to build on my diploma thesis, in which I dealt with advocacy and justice in Victorian England and extend it to Scotland and Ireland. I began my work by summarizing the development of these occupations before the Victorian period, where it is already evident how England tried to influence and subjugate these two countries. Mainly, Ireland tried to resist revolutions of various sizes at the beginning of the 19th century, and mainly by having its own educational institutions for lawyers. This was also the case with Scotland. I devote a considerable part of my work to prominent judges and advocates, even in England, where there is no room left for judges. During the reign of Victoria, England became a world power, the development of justice and advocacy brought with it a lot of changes and a significant unification of the system. The reform of the Judicature Act (1873-1875) revolutionised the simplification of justice as the first step towards the unification and modernisation of the courts. In the Victorian period, the legal profession continued to develop and was further anchored in the legal system. Its two main parts, barrister and solicitors, are still an integral part of UK law. The difference between English and continental law is considerable. English law is not based on the use of the law as the primary source of law, as is the case with continental law. The primary is the use of common law and equity, and precedents. Even in England, however, there are a number of laws, both historically preserved and contemporary. Judicial precedents are therefore not an exclusive source of law, but are essential for the legal system. England has retained its specific status of justice and advocacy to this day. Emphasis is placed on the historical development and preservation of the hierarchy of justice. The Bar Council and The Law Society are still important in advocacy today. The legal system is historically very important and very characteristic within Europe. The aim of this thesis was to create a comprehensive overview of the development of legislation since the breakthrough changes of the Victorian period, when such a summary could be not only interesting, but also beneficial for expanding the overview in further cooperation with Great Britain.
