Diversion in criminal proceeding

Abstract:

Tato magisterská práce pojednává o aplikaci odklonů v trestním řízení v českém právu. Odklon chápeme jako alternativní způsob řešení trestních věcí, který při splnění zákonem definovaných podmínek dává možnost věc vyřešit jinak, než klasicky, tedy rozsudkem vydaným během hlavního líčení. Začátek práce je věnován charakteristikám a popisům jednotlivých odklonů včetně definování základních podmínek pro jejich aplikaci. V další části se práce zaměřuje na Probační a mediační službu jako nástroj moderní restorativní justice. V poslední části práce zachycuji vývoj použití odklonu skrze statistiku.

Abstract:

This Master's Thesis is about the application of diversions in criminal proceedings in Czech law. The diversion, we understand as an alternative way of dealing with criminal cases, that when the conditions defined by law are fulfilled, it gives the possibility to resolve the matter otherwise than classical, i.e. judgment during the trial. The beginning of the work is devoted to the characteristics and descriptions of individual diversions, including defining the basic conditions for their application. The next section focuses on the work of the probation and mediation service as a tool of modern restorative justice. In the last part of the work I am getting development using of diversion through statistics.
