Law and Economic Aspects of Providing Subsidities by Local-Self Governments

Abstract:

Bakalářská práce pod názvem Právní a ekonomické aspekty poskytování dotací územně samosprávnými celky je rozdělena do dvou tematických částí, ve kterých se prolíná teorie a praktické příklady z oblasti poskytování dotací. V teoretické části bakalářské práce je stanoven právní rámec poskytování dotací územně samosprávnými celky a řešena problematika žádostí o dotace nebo uzavírání veřejnoprávních smluv. Přiblížen je také systémem finančních kontrol ve vztahu k poskytovaným dotacím. Popsány jsou případy porušení rozpočtové kázně, ukládání odvodů a penále za porušení rozpočtové kázně, ale i možnosti jejich snížení nebo prominutí. V praktické části bakalářské práce je provedena komparace právních předpisů na Slovensku a v Česku, které upravují problematiku poskytování dotací. Závěrem je provedena analýza nedostatků zjištěných při vyúčtování dotací a doporučeny možnosti jejich nápravy. Součástí bakalářské práce je také návrh úpravy souvisejících právních předpisů.

Abstract:

The bachelor thesis Law and Economic Aspect of Providing Subsidises by Local-Self Governments is divided into two thematic parts: theoretical and practical with examples of grants. The theoretical part of the bachelor thesis include a legal framework for the provision of subsidies to territorial self-governing units and the issue of grant applications or the conclusion of public contract. It is also described a system of financial controls in relation to subsidies provided. The theoretical part give also case of violations of budget discipline, the imposition of levies and penalties for breach of budgetary discipline, as well as the possibility of their reduction or remission. In the practical part of the bachelor's thesis there is a comparison of legal regulations in Slovakia and in the Czech Republic, which regulate the issue of providing subsidies. At the end of the thesis, an analysis of the deficiencies found in the billing of subsidies is prepared and the possibilities of their correction are recommended. Part of the bachelor thesis is also the drafting of the related legal regulations.
