Abstract:

Předmětem této diplomové práce je porušování autorských práv k dílu Alfonse Muchy a také objasnění vazeb mezi autorskými a vlastnickými právy v souvislosti se Slovanskou epopejí. Práce je rozdělena do šesti hlavních sekcí. V první části se zaměřuji na historii a vývoj autorského práva ve světě a v České republice. Dále vysvětluji základní pojmy autorského práva a jejich vzájemné spojitosti. Následující dvě části představují Alfonse Muchu včetně jeho nejslavnějších prací a diskutují význam nadace Mucha Foundation. Poslední kapitoly jsou věnovány příkladům porušení autorského práva, ke kterým jsem se při psaní této práce dostala. Patří sem i celý spor týkající se umístění Slovanské epopeje a vzniklé situace související s nárokem na vlastnictví tohoto díla. Celkové zhodnocení porušování autorských práv a důsledků vyplívajících z oprávněného vlastnictví Slovanské epopeje je uvedeno v závěru práce.

Abstract:

The subject of this thesis is the infringement of copyright in reference Alphonse Mucha’s works and also the clarification of the links between copyright and ownership rights specifically related to the Slavic Epic. The work is divided into six main sections. First I focus on the history and development of copyright law in the world and in the Czech Republic. Next I explain the basic concepts of copyright and their mutual connections. The following two sections introduce Alphonse Mucha and include his most famous works and discuss the Mucha Foundation and its importance. The last chapters describe examples of copyright infringement which I found during the writing of this thesis. They also include an entire argument relating to the Slavic Epic and the situation associated with the claim of ownership of this work. An Overall assessment of copyright infringement and the consequences resulting from the legitimate ownership of the Slavic Epic is stated in the conclusion.
