Acquisition of the right of ownership in an immovable thing according to Act No. 89/2012 Coll., the Civil Code

Abstract:

Diplomová práce se zabývá analýzou smluvního nabytí vlastnického práva k věci nemovité formou kupní smlouvy podle NOZ s cílem charakterizovat výhody, nevý-hody a rizika v případě účasti nebo bez účasti realitního zprostředkovatele na celém procesu včetně doporučení optimálního postupu.Teoretická část se věnuje rozdílům mezi vlastnictvím a vlastnickým právem, vy-světluje, co se skrývá pod pojmem věc nemovitá a blíže se věnuje také pojmům pří-slušenství a součást věci. V neposlední řadě rozvádí, jaké jsou způsoby nabývání vlastnictví k věcem nemovitým. Tyto způsoby nabývání vlastnictví systematizuje a strukturuje zejména na tzv. originární a derivativní nabývání vlastnictví k věcem nemovitým. Praktická část práce se zabývá analýzou a hodnocením rizik spojených s nabytím nemovitosti bez účasti a s účastí realitního zprostředkovatele na základě dvou pří-padových studií. Výstupem této práce je doporučení optimálního postupu při nabytí vlastnického práva k věci nemovité formou kupní smlouvy dle NOZ.

Abstract:

This diploma thesis deals with the analysis of the contractual acquisition of the right of ownership in an immovable thing through purchase contract according to Act No. 89/2012 Coll., the Civil Code, as amended (hereinafter referred to as „NOZ") in order to describe advantages, disadvantages and risks in the whole process in the case of participation or absence of real estate agent, including reccommendation to optimal procedure. Theoretical part deals with differences between ownership and right of ownership, explains the meaning of an immovable thing and also further deals with terms such as accessory to a thing and component part of a thing. Last but not least, this thesis elaborates ways of acquiring right of ownership in an immovable thing. Such ways are systematized and structured into the so-called original and derivative acquisition of right of ownership in an immovable thing.Practical part of the thesis is concerned with analysis and evaluation of the risk associated with the acquisition of the right of ownership in an immovable thing in the case of participation or absence of real estate agent based on two case studies.The aim of this diploma thesis is to recommend optimal procedure within acquisition of the right of ownership in an immovable thing through purchase contract according to NOZ.
