Criminal Offence of Obstruction of Justice According to § 347a of the Criminal Code - Legislative Intervention into Independence of Defense

Abstract:

V této práci se zaměřuji na problematiku možného legislativního zásahu do nezávislosti obhajoby, kdy tímto způsobem může být narušena nezávislost obhajoby po záminkou naplnění trestného činu maření spravedlnosti dle § 347a trestního zákoníku. V práci nejprve vysvětluji, co je a jak funguje nezávislá obhajoba a jaké je její místo a účel v našem právním řádu. Dále se zabývám skutkovou podstatou trestného činu maření spravedlnosti z teoretického a akademického hlediska. V hlavní části je práce zaměřena na kolizi nezávislosti obhajoby a spáchání trestného činu maření spravedlnosti. Srovnávám zde, jak a proč ke kolizi může dojít a zaobírám se možnými řešeními vzniklé situace. V práci ukazuji, jakým způsobem vnímají problematiku odborníci, přičemž jsem se snažil, aby byly zastoupeny všechny úhly pohledu. V závěru práce jsem zařadil náhled do právních řádů jiných států, aby bylo zřejmé, jak se s problematikou vypořádali v zahraničí.

Abstract:

This thesis is about possible legislative intervention into independence of defense. This intervention can be caused by the criminal offense of obstruction of justice according to §347a of the Criminal Code. In the thesis I explain at first what is and how works independence of defense, what is her role and purpose in our legal system. Then I deal with facts of the case (actus reus) of the criminal offence of obstruction of justice in the theoretical and academical aspect. The main part of this thesis is focused on possible collision of the criminal offence and the independence of defense. It´s about how and why can this collision emerge a I introduce some possible solutions. After this it´s showed in this thesis how others perceive the problematics and I tried to offer to the reader all points of view. At the end of the thesis is a preview to different systems of law to show us how they deal with the problematic in others countries.
