Interrogation of an Accused with the Accent on false Confessions

Abstract:

I při současné technické vyspělosti je hlavním prostředkem k dosažení dobrých výsledků při výslechu obviněného člověk- v našem případě vyslýchající nebo soudce. Úspěch výslechu je založen na schopnosti vyslýchajícího rozpoznat lež a skryté náznaky, které ho mají dovést k poznání pravdy. Proto jsem se snažil popsat, co všechno může vyslýchající při výslechu využít a čeho se musí vyvarovat. K tomu sloužil i popis způsobu vedení výslechu výslechů. Popis verbální a neverbální komunikace, popis výslechu osoby, která lže a její reakce na obvinění. Aby bylo lehčí odhalit lháře, sepsal jsem klasické techniky používané k zamaskování lži. Věnoval jsem se skladbě a formě výpovědi osoby, která lže a která mluví pravdu. Lokalizoval jsem větné spojení, které jsou charakteristické při lhaní a argumenty kterými se hájí nevinný. Rozebral jsem dilema, která ovlivňují rozhodování pachatele při výpovědi, čeho se bojí, jak čelí obvinění a jak se chovají při výslechu. V mé práci přináším nejpraktičtější informace týkající se výslechu, které jsou doplněny názornými ukázkami, kde se dají uplatnit.

Abstract:

Despite the technical advance, the achievement of good results of interrogation depends largely on a person in charge, especially on an interrogating person or a judge. An interrogating ability of person to uncover a lie and to recognize subtle indications which can help him/her to discover the truth are key to the success of interrogation. Accordingly, I attempted to give an account of all that can be employed and all that must be avoided in the course of interrogation. Also the description of ways of conducting the hearing served this purpose, as well as the description of verbal and nonverbal communication and the depiction of the hearing of a lying person and their reaction to an accusation. To facilitate proving a liar, I assembled classic techniques of disguising a lie. I devoted myself to the structure and form of testimonies of both people who lie and those who tell the truth. I localized phrases which are characteristic of lying and arguments which the innocent use to defend themselves. I analyzed the dilemma which influences a decision of criminal making during the testimony, what they are afraid of, their ways of facing an accusation and behaving in the interrogation. In my thesis, I offer practical information regarding interrogation and vivid examples of its use.
