Drafting and Execution of Reorganization Plan

Abstract:

Tato práce je zaměřena na rozbor reorganizačního řízení se zaměřením na sestavení a provádění reorganizačního plánu. Práce je rozčleněna do několika kapitol, kde se zabývám zejména vymezením reorganizace jako takové, poté se zaměřuji na náležitosti a podmínky pro sestavení reorganizačního plánu a posléze na jeho provádění a v neposlední řadě uvádím postup reorganizačního řízení ve vybrané společnosti, kde teoretické poznatky aplikuji na konkrétní příklad z praxe. Hlavním cílem této práce bylo poskytnutí ucelených informací případným čtenářům, týkajících se reorganizačního řízení zejména podčásti zaměřené na reorganizační plán.

Abstract:

The main topic of this thesis is drafting and execution of the reorganization plan. The thesis is divided into four main sections.The first section, which is called “The definition of reorganization as a way of dealing with bankruptcy“ provides the reader with fundamental information about reorganization as such.The second section, which is called “The reorganization plan“ is focused on defining the reorganization plan, because it can be regarded as a cornerstone of the reorganization proceedings. The third section, which is called “The execution of the reorganization plan“ is mainly focused on the effects associated with the reorganization plan takes effect. The last section is focused entirely practical, where theoretical knowledge is applied to a real company, which underwent a reorganization proceeding.The main objective throughout this thesis is to provide a comprehensive description of the drafting and execution of a reorganization plan and defining effects of the content of the reorganization plan on the course of the reorganization.
