Action for determation and urgent legal interest
Abstract:
Práce se zabývá žalobou na určení včetně historického vývoje právní úpravy se zvláštním zřetelem na výklad institutu naléhavého právního zájmu. Současný výklad naléhavého právního zájmu je demonstrován na řade rozhodnutí soudů v České republice. Práce se zabývá i funkcí a charakterem žaloby na určení.
Abstract:
The theme of the thesis is a presentment of determination including the historical development of a legal form with special consideration of the interpretation of an urgent legal interest. Current interpretation of the urgent legal interest is demonstrated on several decisions of the court in the Czech Republic. Thesis also describes function and status of the presentment of determination.
