Maintenance and General Legal Principles

Abstract:

The main objective of this diploma thesis is to analyse the influence and describe the interconnection between the institute of alimony and general legal regulations and a closer analysis of particular legal regulations. There is an attempt to outline the significance of the impact of legal regulations and their close connection with shaping the form of the obligation of alimony. The thesis tries to highlight the effort of the society to anchor values in the legal regulations which are, subsequently, reflected in the institute of obligation of alimony. So as to solve a case of argument of two rights in relation to the used regulations, the principle of relativity is mentioned. In the final part of the thesis, the prepared form of the new civil code is discussed in relation to legal regulations which make the base in relation to the legal institute of alimony. It also deals with the development tendencies in the field of obligation of alimony in light of integration efforts based on principles in Europe.

Abstract:

Hlavným cieľom tejto diplomovej práce je analyzovanie vplyvu a popísanie vzájomných súvislostí medzi inštitútom výživného a obecnými právnymi zásadami s bližšou analýzou na konkrétnych právnych zásadách. Snahou je načrtnúť význam vplyvu právnych zásad a ich úzku súvislosť s formovaním podoby vyživovacej povinnosti. Práca sa snaží objasniť snahu spoločnosti o zakotvenie hodnôt v právnych zásadách, ktoré sa následne prejavujú v inštitúte vyživovacej povinnosti. Pre riešenie prípadu sporu dvoch práv v súvislosti s použitými zásadami je uvádzaný princíp pomernosti. V záverečnej časti sa práca venuje pripravovanej podobe nového občianskeho zákonníka v nadväznosti na právne zásady, na ktorých spočíva vo vzťahu k právnemu inštitútu výživného. Rovnako sa zaoberá tendenciami vývoja v oblasti vyživovacej povinnosti vo svetle integračných snáh na základe zásad v rámci Európy.
