Bank contracts

Abstract:

Bachelor thesis with the topic the bank's contract shows the importance of banking in a market economy in Slovakia. The emphasis is on relations between the bank and the client on the role and activities of the bank, which is carried out. The aim of bachelor's thesis is an analysis concluding bank contracts with a particular focus on business sphere. The attention is paid to rules of banking contracts, in accordance with applicable laws of Slovakia, mainly in the Commercial Code. It discusses the types of banking agreements by main activities of the bank, which is to receive deposits and lending. The third chapter of the bachelor's thesis deals with the formation of the contract, when and under what circumstances there is and what is necessary to its conclusion. It analyses the contract, changes of contracts and the reasons for termination of contracts. In the last part of the thesis it describes about practical issues of credit contracts in the business, content, obligations of the parties and the conditions for disbursing the loan.

Abstract:

Bakalárska práca na tému Bankové zmluvy poukazuje na dôležitosť bankovníctva v trhovej ekonomike na Slovensku. Dôraz kladie na vzťahy medzi bankou a klientom vzhľadom na funkciu a činnosť banky, ktorú vykonáva. Cieľom bakalárskej práce je rozbor uzatvárania bankových zmlúv s osobitným zameraním na podnikateľskú sféru. Pozornosť venuje právnej úprave bankových zmlúv, v zmysle platných právnych noriem SR hlavne v Obchodnom zákonníku. Ďalej rozoberá druhy bankových zmlúv podľa hlavných činností banky, ktorými sú prijímanie vkladov a poskytovanie úverov. Tretia kapitola bakalárskej práce sa zaoberá vznikom zmluvy, kedy, za akých okolností vzniká a čo je potrebné k jej uzavretiu. Rozoberá náležitosti zmluvy, zmeny, dodatky k zmluvám a dôvody zániku zmlúv. V poslednej časti prechádza na praktické otázky úverových zmlúv v podnikateľskej sfére, obsah, povinnosti zmluvných strán a podmienky čerpania úveru.
