Abstract:
Diplomová práce je zaměřena na pojmy sporného a nesporného řízení v rámci civilního řízení. Nejprve pojednává o civilním procesu jako takovém a o jeho stěžejních zásadách, které jsou následovány historií obou druhů řízení. Dále se práce snaží najít hranici mezi sporným a nesporným řízením za pomoci vybraných kritérií, se zaměřením na jejich odlišnost. Závěrem porovnává českou právní úpravu sporného …more

The thesis is focused on the concepts of contentious and non contentious proceedings in the context of civil proceedings. At first it discusses the civil trial itself and its main principles, which are followed by a history of both kinds of proceeding.
