Criminal, Forensic and Psychological Aspects of the Interrogation of Persons under 15 years of age

Abstract:

Cílem této práce je komplexně pojednat o výslechu osob mladších 15 let především z praktického pohledu příslušníka Policie ČR. Práce je členěna do čtyř kapitol. V první z nich je představena trestní odpovědnost osoby. Ve druhé kapitole jsou představeny trestněprávní aspekty výslechu osob mladších 15 let. Trestněprávní úprava je rozdělena na část obecnou a specifickou. Třetí kapitola pojednává o psychologických aspektech výslechu osob mladších 15 let se zaměřením na vývojová stádia dítěte, sekundární viktimizaci a přístup vyslýchajícího k dítěti. Ve čtvrté kapitole jsou představeny kriminalistické aspekty výslechu osob mladších 15 let. Blíže je představen průběh výslechu, osoba vyslýchajícího nebo specifické pomůcky využívané při výslechu dítěte.

Abstract:

The aim of this thesis is to comprehensively introduce the interrogation of persons under 15 years of age especially from a practical point of view of a member of the Police of the Czech Republic. The thesis is seperated into four chapters. The first of them presents the criminal liability of the person. The criminal law aspects of interrogation of persons under 15 years of age are presented in the second chapter. The criminal law is divided into a general and a specific part. The third chapter deals with the psychological aspects of interrogation of persons under 15 years of age, focusing on the developmental stages of the child, secondary victimization and the interrogator’s approach to the child. The forensic aspects of interrogation of persons under 15 years of age are presented in the fourth chapter. There is discription of the course of the interrogation, interrogator or specific aids used in questioning a child.
