Stalking- criminal and criminological aspects

Abstract:

Tato diplomová práce se zabývá podstatou stalkingu, jako moderního fenoménu ve společnosti. V úvodních kapitolách vymezuje samotnou definici a historický vývoj tohoto jevu. V následujícíh kapitolách přibližuje pojetí stalkingu v různých zemích a jejich umístnění do trestního systému. Následuje rozbor možnosti postihu stalkingu před a po zavedení nové skutkové podstaty trestného činu nebezpečné pronásledování do českého trestního zákoníku. V části: Kriminologické poznatky se práce věnuje motedám stalkerů, možnými příčinami a osobnostními rýsy jednotlivých pachatelů. Část této kapitoly rozebírá problematiku obětí stalkingu a možnostem jejich ochrany a obrany.

Abstract:

This work deal with substance of stalking as modern phenomen in society. In the introductory chapters it specifies definition and historical developement of this occurence. In following chapters it tries to describe the conception of stalking in different countries and its position in theirs criminal system. Then it follows analysis the possibilities of stalking sanction before and after establishing the new crime- so called stalking into a czech crimninal code. In part named criminological findings deal with techniques of stalkers, potentional causes of stalking and with characteristical trait of individual offenders. Part of this chapter engages in victims of stalkers and possibilities of theirs protection and defence against stalking.
