The Status of the Victim in Criminal Proceedings

Abstract:

Tématem diplomové práce je postavení oběti v trestním řízení. V první kapitole jsou rozebrány pojmy oběti, poškozeného a jejich možné vzájemné prolínání včetně jejich právního zakotvení jak na evropské, tak na vnitrostátní úrovni, které popisuje kapitola druhá. Specifické zaměření práce reflektují dvě následující kapitoly. Kapitola třetí zachycuje viktimologické souvislosti problematiky, v kapitole čtvrté je nastíněn pohled ze strany restorativní justice. V rámci obou kapitol je zhodnoceno promítnutí těchto přístupů v právní úpravě včetně rozboru jejich vhodnosti a přínosu. Kapitola pátá se samostatně věnuje postavení poškozeného v trestním řízení tak, jak ho upravuje trestní řád. Kapitola šestá se zabývá nedostatky, jež vykazuje současná právní úprava ve vztahu k obětem trestných činů. Stručné představení zákona o obětech trestných činů obsahuje kapitola sedmá. Cílem práce je tak shrnout problematiku právního postavení oběti trestného činu, analyzovat jejich jednotlivá práva v rámci trestního řízení a zhodnotit jejich soulad s požadavky plynoucí ze strany Evropské unie.

Abstract:

The topic of the Diploma Thesis is the position of a victim in criminal proceedings. The first chapter defines the terms of a victim, an injured party and their possible mutual permeation including their legal protection both at the European and internal levels, which are described in the second chapter. The specific focus of the thesis is reflected by the two following chapters. The third chapter deals with the victimologic context of the issue while the fourth chapter outlines the view taken by restorative justice. Projection of these approaches in legislation including an analysis of their suitability and benefit is assessed within both chapters. The fifth chapter separately focuses on the position of an injured party in criminal proceedings as governed by the Criminal Code. The sixth chapter deals with imperfections of current legislation in relation to victims of criminal acts. The seventh chapter includes a brief introduction of the Act on victims of Criminal Acts. The aim of the thesis is to summarize the issue of the legal position of victims of criminal acts, to analyse their individual rights within criminal proceedings and to evaluate their conformity to the requirements determined by the European Union.
