Abstract:

Téma mojí diplomové práce „Normotvorba obcí z pohledu judikatury Ústavního soudu“ volně navazuje na problematiku spojenou s vydáváním právních předpisů územně samosprávnými celky, kterou jsem se zabývala ve své bakalářské práci. Mým cílem bylo poukázat na problémy a komplikace, které vydávání právních předpisů obcím přináší a jakou roli při normotvorbě obcí hraje judikatura Ústavního soudu. Pro lepší pochopení všech souvislostí, které s danou problematikou souvisejí, je první část diplomové práce zaměřena na definování a přiblížení právních předpisů obcí v rovině teoretické, na legislativní postup při jejich vydávání a jejich doporučenou strukturu. Další část je zaměřena na dozor správních úřadů, a to jak nad právními předpisy v samostatné působnosti, tak i v působnosti přenesené. Kapitola třetí a čtvrtá se věnuje ústavnímu soudnictví. Přibližuje postavení Ústavního soudu z pohledu Ústavy ČR a českého soudnictví, ale především popisuje působnost a pravomoci, kterými Ústavní soud ve vtahu k právním předpisům obcí, disponuje. Poslední, pátá kapitola, je stěžejní částí celé diplomové práce, neboť se zabývá konkrétními případy obecně závazných vyhlášek, které byly navrhovatelem Ústavnímu soudu předloženy ke zrušení.

Abstract:

The theme of my diploma work "Norm-setting of the municipalities from the point of view of the Constitutional Court" ties up freely with the problem of issuing of legal regulations by regional self-governing units, treated by me in my bachelor work. My intention was to direct the attention to the problems and complications connected with the issuing of legal regulations and to the role of the judicature of the Constitutional Court in the norm-setting of the municipalities. For a better understanding of all relations connected with the respective problems, the first part of my diploma work is directed to the definition and explication of the legal regulations of the municipalities in the theoretical field, to the legislative procedure of the issuing of same and to the recommend structure. The following part is focused on the supervision of the legal regulations by administrative authorities, both in autonomous function and in the transferred force. The chapters three and four are dedicated to the constitutional judiciary, to the position of the Constitutional Court from the point of view of the Constitution of the Czech republic and the Czech judiciary, and, before all, to the competency and force of the Constitutional Court in the field of the legal regulations of the municipalities. The last chapter five presents the essential part of the whole diploma work because of the focusing on specific cases of generally binding decrees submitted to the Constitutional Court for cancellation by the petitioners.
