Abstract:

Diplomová práce se zabývá analýzou právní úpravy smlouvy o dílo obsažené v nově účinném občanském zákoníku. První kapitola je zaměřena na odlišnosti mezi smlouvou o dílo, kupní smlouvou a pracovní smlouvou. Druhá kapitola zkoumá náležitosti tohoto smluvního typu (forma, označení stran, předmět smlouvy a cena za dílo). Třetí kapitola se věnuje právům a povinnostem smluvních stran (obecně, ve vztahu ke stavbě, k dílu s nehmotným výsledkem) a rovněž upravuje vlastnické právo k dílu. Čtvrtá kapitola se zabývá vadami díla a poslední pátá kapitola pojednává o komparaci vybraných právních úprav s nově účinným občanským zákoníkem, a to v oblasti smlouvy o dílo.

Abstract:

This thesis deals with the analysis of the legislation of the contract for work contained in the newly effective Civil Code. The first chapter focuses on the differences between a contract for work, a contract of purchase and an employment contract. The second chapter examines the terms of this contractual type (form, names of the parties, the object of the contract and the price for work). The third chapter is dedicated to the rights and obligations of the contracting parties (generally, in a relation to the construction, to the work with intagible result) and also regulates the ownership of the work. The fourth chapter deals with the defects of the work and the last fifth chapter discusses the comparison of selected legislations with the newly effective Civil Code, in the area of contract for work.
