Implementation of the Law on Defense in Pre-trial Proceedings

Abstract:

Tématem této bakalářské práce je realizace práva na obhajobu v přípravném řízení. Právo na obhajobu je jednou ze základních funkcí v trestním řízení a prochází všemi stadii trestního řízení, nejen přípravným řízením. Bakalářská práce je tvořena 7 kapitolami. V každé z nich nalezneme rozdílné pojetí práva na obhajobu, tak jak prochází trestním řízením, respektive přípravným řízením. V první kapitole bakalářské práce je vysvětlen pojem přípravné řízení, jako jeden z úseků trestního řízení, ve kterém plní orgány činné v trestním řízení, nebo i další osoby zúčastněné na řízení svoje úkoly, využívají svá práva a plní své stanovené povinnosti, aby bylo dosaženo účelu trestního řízení. Dále vymezen účel přípravného řízení, tedy zjistit zda došlo ke spáchání trestného činu, či nikoliv a dle tohoto zjištění, výsledku poté rozhodnout. V neposlední řadě je rovněž uvedena právní úprava přípravného řízení. Druhá kapitola se zabývá samotnou obhajobou a právem na obhajobu. Smyslem obhajoby je v celém průběhu trestního řízení ochrana zájmů obviněného, případně podezřelého (ve zkráceném přípravném řízení). Jsou zde vymezeny jiné osoby s obhajovacími právy a jejich podíl na trestním řízení. Další část kapitoly je věnována obhájci, jeho právům a povinnostem a dále také vyloučení a zproštění obhájce, včetně důvodů vyloučení nebo zproštění obhájce. Ve třetí kapitole je popsáno samotné zajištění práva na obhajobu. Vymezena je zde nutná obhajoba, tzn. situace, kdy obviněný musí mít obhájce a to i v případě, že si jej sám nezvolí nebo zvolit nechce. Taxativní případy, kdy se jedná o nutnou obhajobu nám stanoví zákon. S tím související je i bezplatná obhajoba a obhajoba za sníženou cenu. Jedná se o situace, kdy obviněný je bez finančních prostředků a náklady obhajoby, tak hradit nemůže vůbec a nebo může pouze zčásti. Současní je i právní úprava nutné obhajoby, bezplatné obhajoby a obhajoby za sníženou cenu. Čtvrtá kapitola se zabývá postupem před zahájením trestního stíhání, což je takový úsek trestního řízení, kdy policejní orgán je povinný na základě vlastních poznatků, trestních oznámení i podnětů jiných osob a orgánů prověřit, zda vůbec došlo ke spáchání trestného činu a vlastním šetřením zjistit, zda zjištěné skutečnosti důvodně nasvědčují tomu, že trestný čin spáchala konkrétní osoba. Kapitola rovněž obsahuje možnosti rozhodnutí, které přicházejí v úvahu před zahájením trestního stíhání. Dále je část věnována zadrženému podezřelému a jeho právu na obhajobu. Je vytyčena právní úprava a dále kdo, kdy a za jakých podmínek může osobu zadržet. Pátá kapitola nám rozebírá další úsek trestního řízení a to zahájení trestního stíhání, kterým se zahájí trestní stíhání proti konkrétní osobě. Trestní stíhání je zahajováno, pokud nasvědčují zjištěné a odůvodněné skutečnosti tomu, že byl spáchán trestný čin, a je-li odůvodněn závěr, že jej spáchala určitá osoba. Jsou zde rozebrány náležitosti Usnesení o zahájení trestního stíhání a další náležitosti týkající se doručení uvedeného usnesení a dále práva na obhajobu spojená se zahájením trestního stíhání. V šesté kapitole je pojednáno o další fázi trestního stíhání, která následuje po zahájení trestního stíhání a kterou nazýváme vyšetřování. Je zde rozebrán postup ve vyšetřování, uvedeny tři formy přípravného řízení, kterými jsou standardní přípravné řízení, rozšířené přípravné řízení a zkrácené přípravné řízení a dále rozdíly mezi nimi. ezi která patří právo na poučení a poskytnutí plné možnosti uplatnění práv, právo vyjádřit se k obvinění podrobně, právo nahlížet do spisů, právo účastnit se úkonů, právo uvádět okolnosti a důkazy sloužící k obhajobě, právo činit návrhy a podávat žádosti a právo podávat opravné prostředky. Poslední sedmá kapitola je věnována právu na obhajobu ve zkráceném přípravném řízení. Jsou zde rozebrány specifika tohoto řízení a rovněž práva osoby, proti které se zkrácené přípravné řízení vede.

Abstract:

The theme of this thesis is the realization of the rights of the defense in pre-trial proceedings. The right to defense is one of the basic functions in criminal proceedings and go through all stages of criminal proceedings, not only through the preliminary proceedings. Bachelor thesis consists of seven chapters. In each of them can be found different interpretation of the right for defence. As it is go through the criminal proceedings, or let us say through pre-trial proceedings. In the first chapter of the bachelor thesis is explained the notion of pre-trial proceedings, as one of the sections of criminal proceedings in which the prosecuting and adjudicating bodies or also other persons involved in the proceedings fulfilling their tasks, they are using their rights and they are fulfilling their determined obligations in order to achieve the purpose criminal proceedings. Further defined the purpose of pre-trial proceedings, is to determine whether there was a crime committed or not, and according to this finding the result then decide. Finally, it is also stated the legal regulation of pre-trial proceedings. The second chapter deals with the defense itself and the right to defense. The purpose of the defense in the entire course of criminal proceedings is to protect the interests of the accused or suspect (in summary proceedings). There are other persons with defined defensive rights and their share on the criminal proceedings. Another part of the chapter is devoted to counsel to his rights and duties and also exclusion and discharge of counsel, including the reasons of exclusion or excemption of the counsel. The third chapter describes security for a defence itself. There is defined compulsory defence, ie. situation when the accused must have defense counsel, even if he him does not choose any or don’t want to choose any. Enumerative cases when it is concerned about compulsory defence is determined by the Law.It is connected with this free of charge defence or defence for reduced price. It is a situation where the accused is without funds and he can not pay costs of defense, he can not pay that at all or can only partially. Component part is also the legislation of compulsory defense, free defense and the defense for a reduced price. The fourth chapter deals with the procedure before the commencement of criminal prosecution, which is a section of the criminal proceedings, when the police authority is obliged on the basis on their own findings of a criminal information complaints and suggestions of other persons and bodies to examine whether there was ever committed the crime and by own investigation to find out whether the findings reasonably suggest that the crime was committed by a particular person. The chapter also includes the possibility of a decision under consideration before commencement of the criminal prosecution. Furthermore, the part is devoted to the suspect which was arrested and his right to defense. It is marked out outlined the legal regulation and who, when and under what conditions a person can arrest the person. The fifth chapter discusses the next leg of our criminal proceedings namely commencement of criminal prosecution by which will be commenced the criminal prosecution against a specific person. Criminal prosecution is initiated if the detected and reasoned facts suggest that the crime was committed, and if it is reasoned the conclusion that it was committed by concrete person. There are are discussed the requirements resolution to commence the criminal prosecution and other requirements relating the delivery of mentioned resolution and the rights for connected with the commencement of criminal prosecution. In the sixth chapter, is discuss the next stage of criminal prosecution, following after the commencement of criminal prosecution which we are calling investigation. of pre-trial proceedings, which are standard pre-trial proceedings, extended pre-trial and short pre-trial proceedings and the differences between them. There also analysed specific rights of the accused in the investigation, among which include the right for advice and the provision of full scope for claiming the rights, right to express opinion to accusation in detail, the right to inspect files, the right to attend the acts, the right indicate the circumstances and evidence serve for the defense, the right to make proposals and submit applications and the right submit remedial measures. The last seventh chapter is devoted to the right of defense in shortening proceedings. There are discussed the specifics of this procedure and also the rights of the person against whom the shortening pre-trial results.
